Husband not giving talaaq

Assalam ou alaikum,If a man does not want to give talaq to his wife,I understand that the woman can ask an imam or somebody of similar stature to grant her a talaq,Is that right?and if the talaq is granted what is the position with the man,can he still live at the house or would have to move out,what if he has not got any where to go?

Answer

Wa alaikumus salaam.Talaaq lies solely in the hand of the husband. Nobody is authorised to give it to her. In some cases where the wife is undergoing hardships the nikaah can be dissolved by a committee composed of competent Ulama if the committee find solid ground and concrete evidence to do so. Eventually if the woman is separated by dissolution or by talaaq, they won't be allowed to live together in the same house. If the house belongs to the husband then the wife will have to move out after her iddat. And if it's her house then he will have to move out.
