Question
assalamualaikum..
refer to my question Num: 1336.. you told me that :
" Talaaq uttered in a state of anger is effective. 3 Talaaq given in one go is considered as 3. Talaaq of an insane is null and void. Choose yourself which of these 3 cases apply to you."
I went to the psycologue told her how the situation was during the problem and been told that,
" The provocation leads to a temporary suspension of the thinking faculty, and a full expression of the primitive anger. That is why, during anger, it is difficult to determine how angry to get, and when or where to stop. No wonder, anger has been called temporary insanity, and being angry is informally called ‘being mad’.
Anger may be precipitated by a variety of situations."
and the way I was in, it is called " temporary insanity "
even a normal person can get im that kind of anger,
and again what I have read on " Talaq in anger " are below :
1- When a person is angry and is no longer aware of what he is doing. This is likened to the insane, so divorce does not take place according to all scholars.
2 – Where a person is very angry but is still aware of what is going on, but his anger is so intense that it makes him say the words of divorce. In this case too, divorce does not take place according to the correct scholarly opinion.
3 – The ordinary type of anger which is not very intense. In this case, divorce takes place, according to all the scholars. From Fataawa al-Talaaq, pp. 19-21, compiled by Dr. ‘Abd-Allaah al-Tayyaar and Muhammad al-Moosa.
and again, I'm not insane but was only in a " temporary insanity "
I have never thought of giving talaq to her, nor even thought of those words talaq in that moment..I was just Insanely angry with her, and she provoked me to say it. and I could not control my words nor aware what I was saying & and it just came out.
I not trying to make me look like I know everything, its just that I am not getting a clear answer on my problem, im really stressed by this, " deprimer " ..
I am sorry if ever I'm making a mistake by asking again.
thank you a lot by your answer..
assalamualaikum
Answer
Wa alaikumus salaam
You have a fatwah by you and you know yourself to what extent you were insane. You can decide in which category you were. Please don't put the burden upon us to decide as we are satisfied in saying that the talaaqs are effective. Unless it is proven that the husband was categorically insane. And we are not illegible to decide whether he was or not.
