what is the position of a muslim who refuses to accept a fatwa given by an Ulama panel? with reference please.
Answer
Wa alaikumus salaam
A fatwa is a legal guidance of a pious and knowledgeable scholar on any matter of Shariah, based upon the 4 sources of Shariah namely: Quraan, sunnah, Ijmaa and Qiyaas.
Since a layman is unable to come to a conclusion on matters of Shariah, he definitely has to rely on a certain Mufti or a Darul ifta. Now, to prevent him from following his nafs (desires) and from doing fatwa shopping, which is a serious matter in deen, he has to stick to one Avenue only. It will not make a difference whether it's a specific Mufti, a Darul ifta or even a panel of mufti.
A fatwa is binding upon a layman. Refuting it or disrespecting it is so serious that it can lead to kufr. Therefore, one should take utmost precautions in this line.
