Inheritance for 2 real brothers from the father's side / agnate brothers

QUESTION:

A person passed away. He does not have a wife, children or parents. He has 2 real brothers and 2 step brothers from his father’s side/agnate brothers. How will his estate be distributed?

ANSWER:

A person who has no close family members such as a father or children is called a Kalaalah. The inheritance of such a person is distributed among his brothers and sisters. But his real brothers and sisters will have priority over his step-brothers and step-sisters. In this case, since the person has two real brothers, the step-brothers will not be entitled to inheritance. It is only the two real brothers who will share the inheritance equally / in halves.
