Question

Assalaam u'alaikum. I am in love with a girl and Insha'Allah I want to marry her. However, I am a surtee and she is a non surtee and my mom is against marrying me to someone who is outside my caste despite acknowledging the girl is a good person. Please advise because i don't want to commit zina or disobey my parents.

Answer

Wa alaikumussalaam,

Equality in marriage, known as kufw in Arabic, is considered important in Shariah. In case nikah takes place outside the kufw, and the Wali objects, he can dissolve the marriage through the shariah court (if available) or Ulamas/Pious muslim people council before the child is born. Kufw is considered in the following things: in piety, in wealth, in lineage and in the profession.
When it comes to caste, Ajam meaning non-Arabs are all equal, Nikah between them is not considered against kufw.
And finally it's only the Walis (men of the family) like the father, grandfather, brother, uncle etc.sequentially that have the right to objection.
So your mother's objection on the matter of caste is not valid according to shariah. Looking down upon someone just on the caste basis and to have pride and takabbur upon our caste is forbidden and Haram according to shariah.
The advice would be, although you have the legal right by Shariah to marry this girl, the best would be to convince your mother and receive her approval and her duas.
