Answer
Wa alaikumussalam.
Haamidan wa Muswalliyan wa Billahis Swawaaab ...
According to Islamic Law of inheritance, first of all, we have to evaluate all the properties and add it with money she has.
Then, we should
1) exclude her funeral expenses .
2) Pay her debts such as any loans or mortgages etc.
3) Apply her permissible Wasiyyah if she had made such as contribution in masjid , madrassa or for some any relatives etc.
Note that the Wasiyyah will apply to 1/3 of the whole wealth after evaluation.
After executing the above 3, we will now proceed to the shares of the inheritors.
The mother will get 1/6 .
The husband will get 1/4.
From the remaining wealth, the son will get 2/3 of it and the daughter will get 1/3 of it.
Henceforth, the winding up will be as follows:
We will devise the wealth in 36 portions
The mother will have 6/36 .
The husband will have 9/36.
The son will have 14/36.
The daughter will have 7/36.
Note: if the couple had a civil contract as the Mauritius law, the husband and other inheritors will take the portion according to the gouvernment law and then they can distribute it as mentioned above by Islamic Law.
