Marrying a girl who is pregnant by another person through Zina

Question:

If the girl is pregnant by another person through Zina, is it permissible for this boy to marry her?

Answer:

According to some scholars, it is not permissible for a man to marry a girl who fell pregnant through another man due to Zina. But there are many scholars who are of the opinion that it is permissible to marry but it is not permissible to be intimate until the woman has given birth because Nabi (Sallallaahu Alaihi Wasallam) said:

"A person who has Imaan in Allah Ta’ala and the last day (of judgment) must not allow his water to water the plant of another person."

To water the plant of another person means being intimate with a woman who is pregnant through another man. According to this Hadith, it is prohibited to be intimate with such a woman. This means that the Nikah is valid, but if the child is not for the person to whom she is marrying, it is not permissible to be intimate as long as the she does not give birth.
