Talaaq during pregnancy

Question:

Fiqh - Talaaq

A man gave his wife one Talaaq during her pregnancy. After a few days, the woman gave birth. After giving birth, her husband gave her two more Talaaq. What is the status of this marriage according to the Shari’ah?

Answer:

The woman is already out of the Nikaah of her husband after childbirth through that one Talaaq. Thus, after giving birth, she was no longer his wife. The two Talaaq that the husband gave her, are not binding because she was not his wife anymore. According to the Shari’ah, there is no bond  of Nikaah between that husband and the wife. However, if they want, they can perform Nikaah again and come back together. The need of Halaalah does not arise in this case.
