Giving 3 Talaaq in one go

It is not permissible to give three Talaaq at once. But if all three have been given at once, then all three Talaaq will be valid. Excuses cannot be made that they are not valid because it is not permissible to give it in that manner. All three is valid and that is the view of all the Sahabah-e-Kiraam and the four Imaams.

In the same way, it is not permissible to give Talaaq when a woman is in Haïz. But if it was given, it is counted.

Giving three Talaaq at once

When a person gives three Talaaq at once, three Talaaq become binding. This is what all the Sahaabah (Radiyallahu Anhum) have understood. This is what Hazrat Umar (Radiyallahu Anhu) understood. This is the verdict (Fatwa) of Hazrat Abdullah Bin Abbaas (Radiyallahu Anhu). This is what all the 4 Imaams have understood. If we say that 3 Talaaq count as one Talaaq only, it means that Hazrat Umar (Radiyallahu Anhu) did not understand the Qur’an-e-Kareem and the Hadith.

Giving Talaaq

Talaaq is a means or a facility that the Shari’ah has granted to end a conjugal union that cannot continue to respect the right of the other and the limits that Allah Ta’ala has established. Nonetheless, as far as possible, Talaaq should not be pronounced as it is something which is binding even jokingly. That is why one must take a lot of precautions and try to forget it.

Talaaq during pregnancy

Question:

Fiqh - Talaaq

A man gave his wife one Talaaq during her pregnancy. After a few days, the woman gave birth. After giving birth, her husband gave her two more Talaaq. What is the status of this marriage according to the Shari’ah?

Answer:

The best way to give Talaaq

One should never give one’s wife the three Talaaq all at once. If the situation requires giving her Talaaq, then only one Talaaq should be given when she is in her period of purity, in which no intimacy took place. She should then do her iddat of three Haiz.  No further Talaaq besides this should be given. If the couple has decided not to live together anymore, only one Talaaq suffices to separate them and give each one their freedom.
