THREE TALAAQ

Three talaaq at once and the Ulama

There is difference of opinions among the Ulama in the case of a person who tells his wife, "I give you three talaaq / you are divorced thrice." Regarding this, Imaam Shafi’i (Rahmatullahi 'alayh), Imaam Malik (Rahmatullahi 'alayh), Imaam Abu Hanifah (Rahmatullahi 'alayh), Imaam Ahmad (Rahmatullahi 'alayh) and the majority of the past and present Ulama, say that all the three Talaaq become binding. (Commentary on Saheeh Muslim by Allaamah An-Nawawi [Rahmatullahi 'alayh] 631 H - 676 H)

Continuing to live together after three Talaaq

Continuing to live with a woman to whom you have given three Talaaq is like living with a woman without having performed Nikah. To live with a woman without having performed Nikah is Haraam because there is no difference between Zina and this way of life. Therefore, to continue living with a woman to whom you have given all the three Talaaq is like living in Zina. The Salah, Roza, Hajj, ‘Umrah of such a person are in vain because he is living 24 hours a day in Haraam. Do not be fooled by a person who tells you that 3 Talaaq count as one because that person does not know Deen better than Hazrat Umar (Radiyallahu Anhu) who said that when a person gives 3 Talaaq, it is 3 Talaaq – even if the three Talaaq were given at once.
