Stop living in Haraam!

If a person has given his wife all the three Talaaq at once, he does not have the right to continue living with her. Continuing to live with her is living in Haraam. If death overtakes him in this state, it means that he is dying in a state where he was living in Haraam. Similarly, if a husband gave his wife the three Talaaq, she must not return to him, otherwise she will be living in Haraam forever.

Fake Salafi

In Mauritius, there is a group that identifies themselves as Salafi. However, they do not follow the Salaf. Thus, how can they identify themselves as Salafi? It is evident that they are false Salafis who are  spoiling the image of the true Salaf all over. The Salaf are unanimous that three Talaaq that is given at once, count as three. But they say that it counts as one. This shows that they are not true Salafi, they are false Salafi.

Khula'

Khula' means giving Talaaq in lieu of payment of a sum of money or anything that has a commercial value. This can be proposed by the wife just as it can be proposed by the husband. But in any case, this is concluded by mutual consent of both parties. That is, the woman cannot get her Khula' without the consent of her husband, nor can a certain committee or organisation give Khula to a woman without the authorisation and consent of her husband.

Nikaah / Talaaq / Iddat

In principle, Talaaq is detestable. This is because it is a way to break a Nikah which is a blessing from Allah Ta'ala. It is reprehensible to disregard a blessing. So Talaaq is like brushing off the blessing of Nikah. So, it is something detestable. Moreover, this rupture creates hatred between two persons and by extension, between two families. What the children bear due to that is something apart. This is why Talaaq should not be given.

Only one Talaaq

Marriage is not a matter of one or two days. It is a matter of life. That is why it is a mistake, (in general), to think about giving Talaaq. However, sometimes this 'error' has to be made in order to rectify a more serious mistak. And this is done by giving Talaaq. The fact that Talaaq is something detestable, minimum use should be made. The minimum is one Talaaq only. One Talaaq only suffice to separate a couple even if the two parties do not have any intention to revoke it afterwards.

Irreparable!

There are certain things which are very serious but we do not take into account. For example, a son-in-law kisses his mother-in-law. Such an act is not allowed. One can say that he is like one’s son. But the truth is that he is not one’s son. If somehow anyone of them felt a sensation during the act of kissing, then serious consequences which are irreparable, fall into place. The Nikah of the daughter of the mother-in-law is nullified and she becomes Haraam for her husband forever. It is something that can never be mended/patched up.

Khula

Khula is a request for Talaaq from the woman’s side. In this request, the woman offers a sum to her husband so that he gives her Talaaq in return.

Once, during the time of Rasulullah (Sallallaahu Alaihi Wasallam), a woman came by Nabi (Sallallaahu Alaihi Wasallam) and expressed her disgust for her husband and the desire for separation. Nabi (Sallallaahu Alaihi Wasallam) told the woman to return her husband the garden that he had given her as Mahr and to ask for her Talaaq.
