- APPLICATION FOR HALAL CERTIFICATE
Giving 3 Talaaq in one go
It is not permissible to give three Talaaq at once. But if all three have been given at once, then all three Talaaq will be valid. Excuses cannot be made that they are not valid because it is not permissible to give it in that manner. All three is valid and that is the view of all the Sahabah-e-Kiraam and the four Imaams.
In the same way, it is not permissible to give Talaaq when a woman is in Haïz. But if it was given, it is counted.
Just as a knowledgeable person is chosen to perform one's Nikah, in the same way a knowledgeable person who has experienced and is honest should be contacted before giving Talaaq. Breaking up a marriage is not something trivial. Several of those who are related to the marriage, suffer due to the pleasure, mistake or the negligence of only one person. One should analyse the pros and cons before taking a decision to separate. When one sees that it is more harmful to stay together than to separate, then in such case, there should be separation. Once the decision of separation has been taken, only one Talaaq should be given. By giving a single Talaaq, all options are still available. One will have the right to return to one's wife before the completion of Iddat. In such a case, there will be no need to renew the Nikah if the Talaaq was a TalaaqRaj'i (a revocable Talaaq).
If one does not revoke the Talaaq until the completion of the Iddat, then one's wife will be out of Nikah and she will be free to contract a new Nikaah elsewhere. Moreover, if, after the Iddat, both of them decide to reconcile, they will be able to. In this case, they must renew the Nikah. All these facilities are available in giving a single Talaaq without being the cause of trouble to anyone. The problem arises when we do not accept the facility that the Shariah gave us. That is why the mistake becomes irrevocable.
People who are not that serious in Deen, return to their ex-wives despite this not being permissible. They agree to live in Haraam forever, not realising the harm that they are causing to themselves. It is still not too late if one has realised it despite having already lived a considerable amount of time in this hell of Haraam. One may discontinue and repent. It is never too late to make Taubah.
There is another extreme in married life. A person may find all types of faults in his wife but refuses to give Talaaq. He may make pretext that he does not want to shake the throne of Allah Ta'ala. Yet he may be committing several blunders and a series of mistakes in his life. But he only finds Talaaq that will shake the throne of Allah without taking into account the wrongs that he may be committing. Thus, in actual fact, he is withdrawing Talaaq merely due to malice and for personal interests. When a person realises that he will not be able to establish the commandments of Allah Ta'ala in his married life and he sees that his wife does not want to stay with him, then it is his duty to do the necessary. That is, to separate by giving one Talaaq. Is it right to force someone to live with you when she does not want to? No doubt, this is not an honour for a dignified person. It is rather baseness.
It is true that there is the possibility that a woman may use Nikah as a means to consume the wealth of others/her husband. That is, in cases where a substantial Mahr has been fixed in the marriage. If the husband finds that the woman wants to separate without any valid reason, then to remedy this problem, the Shariah authorizes the husband to claim back his Mahr as a condition of giving Talaaq.
The Shariah has made the necessary arrangements so that none of them has difficulties. The problem arises when we do not want to use the facility of the Shariah. Very often, the husband does not want to give Talaaq to his wife even though the wife does not want to continue living with him. In most cases, it is malice that makes the husband want to block the woman. Finally, the worst happens. The woman lives with another and her husband is unable to prevent her. Is it an honour for a man to continue keeping a woman in his Nikah when he knows that the woman is with another? Definitively not. If the woman is one hundred percent wrong, the man also is no less because he can free her and thus the problems will be solved. But he is stubborn and the result is clear. One is living in Zina and the other is living a Dayyus life under the wrath and the curse of Allah Ta'ala.
