Talaaq

Mohammad is married to Fatima, after 2 years Mohammad find another woman and gave Fatima 3 Talaaq.

Assalamualaikoum,

Mohammad is married to Fatima, after 2 years Mohammad find another woman and gave Fatima 3 Talaaq. After some months, Mohammad could not settle with the othr woman and he left her. Now He wants to comme back to Fatima. He asked few Maulanas and all the Maulanas told him that he can't get married to Fatima again because he gave her 3 Talaaq already. After a while he found a sheik who studied in Madina and the sheik told him that he can get married to Fatima again as only 1 Talaaq counted. The sheik performed their nikah and they stayed together and have 2 kids. Now, after 8 years, Fatima fell in love with Ahmad, a divorced man and Mohammad also is involved with some woman. Mahammad and Fatima fights everyday and they don't talk to each other. Fatima is saying that she is going to marry Ahmad because she is staying in zina with Mohammad all these years. (Definitely she is using this as an excuse now).

1) Did the nikah the Sheik perform valid or not?

2) Does the 2 kids legitimate or illegitimate?

3) What is the best things for Mohammad and Fatima to do now onwards?

Jazak Allah

On August 2017 my husband gave me one talaaq by saying “I give u a talaaq”.

Assalamoualaikoum

On August 2017 my husband gave me one talaaq by saying “I give u a talaaq”. When I asked him whether he gave me one talaaq, he said yes. He angrily said that he did it just for a nonsense reason.

Then on 1st December 2017 he told me that he gave me all talaaq that exist in the world. After saying that he also said that his intention was not to give me talaaq intentionally, but he just pronounced it like that. So he said that the talaaq is not valid, and we can stay together, so no need to live separately.

Now I want to know if it’s really okay for us to stay together. If not, then when my iddat supposed to start and what should I do during my iddat and what I shouldn’t do?

Please advise ..jazakallah

assalamualaikum..
refer to my question Num: 1336.. you told me that :
" Talaaq uttered in a state of anger is effective. 3 Talaaq given in one go is considered as 3. Talaaq of an insane is null and void. Choose yourself which of these 3 cases apply to you."

I went to the psycologue told her how the situation was during the problem and been told that,
" The provocation leads to a temporary suspension of the thinking faculty, and a full expression of the primitive anger. That is why, during anger, it is difficult to determine how angry to get, and when or where to stop. No wonder, anger has been called temporary insanity, and being angry is informally called ‘being mad’.
Anger may be precipitated by a variety of situations."
and the way I was in, it is called " temporary insanity "
even a normal person can get im that kind of anger,

and again what I have read on " Talaq in anger " are below :
1- When a person is angry and is no longer aware of what he is doing. This is likened to the insane, so divorce does not take place according to all scholars.
2 – Where a person is very angry but is still aware of what is going on, but his anger is so intense that it makes him say the words of divorce. In this case too, divorce does not take place according to the correct scholarly opinion.
3 – The ordinary type of anger which is not very intense. In this case, divorce takes place, according to all the scholars. From Fataawa al-Talaaq, pp. 19-21, compiled by Dr. ‘Abd-Allaah al-Tayyaar and Muhammad al-Moosa.

and again, I'm not insane but was only in a " temporary insanity "
I have never thought of giving talaq to her, nor even thought of those words talaq in that moment..I was just Insanely angry with her, and she provoked me to say it. and I could not control my words nor aware what I was saying & and it just came out.

I not trying to make me look like I know everything, its just that I am not getting a clear answer on my problem, im really stressed by this, " deprimer " ..

I am sorry if ever I'm making a mistake by asking again.
thank you a lot by your answer..

I got a problem wirh my wife and she provoked me to say 3 talaq

Assalamualaikum I got a problem wirh my wife and she provoked me to say 3 talaq and said 3 talaat in one go but in an insane anger without releasing what I was saying, but I did some research in Fiqr Book and with some imaam and mufti.. at the end I did not get any verdict either my nikkah is still valid or not, soem says 3 in one go is 1 ansld some says 3 is 3 and also some told me if I was that insane angry without realising what I said, talaq does not count at all, thats why im still confuse and do not know what to do" and I did some more reseaech and found this.... " If you uttered the words of divorce at a moment of intense anger and without realizing it, and you could not control yourself, because of her bad words and insults etc., and you did that at a moment of intense anger and without realizing it, and she acknowledges that, or you have a witness of good character, then divorce has not taken place, because the shar’i evidence indicates that divorce does not take place if the words are spoken at a moment of intense anger – and if it is accompanied by not realizing what is happening then the ruling applies even more so. " Anger may be of three types: 1 – When a person is angry and is no longer aware of what he is doing. ‘Abd-Allaah al-Tayyaar and Muhammad al-Moosa. the type of anger i was in was the 1st type. I even asked the imaam who did my nikkah, he told me to get in contact with his mufti, I called him and explained everything to him and he said he can not say anything about it, only me know the truth of how anger I was . and also said if I want him to give a fatwa and verdict..I need.to consult a psycologue to get a report either my anger was intence or not. and the problem is that, the incident happened last year, and aster realisin what happened, we looked and saw that 3 talaq in one go count one in a hadith..so we thought we are still married..but recently 4-5 months ago, her parents got to know about the incident and interfered..that is when we went looking for different mufti and imaam.. and end up with the mufti who told me to look for a PSY but consulting a psycologue wont help much because how I was last year and today..is different, but still I booked an appointment with a psycologue on next thursday. I went to MFC today and explained them, then they referred me here. I am just really confused and really afraid that my nikkah is invalid, but Allah know the best and I hope to get an answer from you soon In Cha Allah assalamualaikum
